Welcome to No1 Events Ltd. The following are the rules or "Terms" that govern use of the No1 Events Ltd Web site ("Site"). By using or visiting the Site, you expressly agree to be bound by these Terms and to follow these Terms and all applicable laws and regulations governing the Site. No1 Events Ltd reserve the right to change these Terms at any time, effective immediately upon posting on the Site. Please check this page of the Site periodically. If you violate these Terms of Use, No1 Events Ltd may terminate your use of the Site, bar you from future use of the Site, cancel your ticket order, and/or take appropriate legal action against you.
BOOKING CONDITIONS & TERMS OF PAYMENT
("the Client") when the client has confirmed requirements by, inter alias, facsimile, letter, written order form or telephone and No1 Events Ltd have accepted such a booking-an invoice being proof of such acceptance.
1. The Contract
A contract shall be deemed to have been made between No1 Events Ltd and the booking client.
Services Provided
No1 Events Ltd are a worldwide broker of event tickets. We specialise in obtaining hard to get tickets to sold out events. Through our many sources we are able to get a wide variety of seats to almost any event in any city. Due to the efforts and costs involved, all seats are sold at above face value.
2. Policies
Tickets for all major events are subject to acceptable availability. Due to the nature of the business, delivery of the tickets may be as late as the day of the event. Odd amounts of tickets cannot be guaranteed together, neither can rows or sections.
3. Price
All prices quoted are exclusive of Vat. In event of the rate of Vat being increased between the acceptance of a booking and an event the client shall be liable to pay such increase before tickets are issued. The premium charged above the face value of tickets, to Sold Out Events, reflect our costs of obtaining preferred seating and are based on supply demand and seat location on your preferred date. If your first choice of ticket is not available we reserve the right to upgrade or downgrade (partial refund) the order to the next available category or to cancel the order with a full refund. All deposits are non refundable.
4. Payment -Tickets Only
4.1 The full price of the booking must be paid immediately upon acceptance of the booking. Once a booking has been made tickets cannot be exchanged or refunded.
4.2 Should an event for any reason be cancelled or rescheduled No1 Events Ltd will strictly only be liable for the face value of the ticket.
5. Cancellation or Variations by the Client
5.1 Any notice of cancellation by the client of a booking or part of a booking must be made in writing by letter sent by recorded delivery to No1 Events Ltd at the address above.
5.2 Any request by the client for a variation to a booking must be made in writing by letter sent by recorded delivery to No1 Events Ltd at the above address and is only effective if accepted in writing by No1 Events Ltd.
6. Consequences of Cancellation by the Client
6.1 Cancellation by the client- Corporate Hospitality, Special Events and Tickets with Corporate Hospitality If a booking or part of a booking is cancelled by the client more than sixty days before the event the client shall be liable for 25% of the total price of the booking. If a booking or part of a booking is cancelled by the client less than sixty days before the event the client shall be liable for the total price of the booking.
6.2 Cancellation by the client- Tickets only In the event of cancellation by the client, the client shall be liable for the total price of the booking.
7. Alterations to advertised packages
7.1 All advertised packages are subject to availability
7.2 Every reasonable effort will be made to adhere to the advertised packages but any package may be altered or omitted or dates changed either before of after confirmation of the booking. Were such alterations, omissions or changes of date occur prior to the confirmation of the booking. No1 Events Ltd accepts no contractual liability. Where such alterations, omissions or changes of dates occur after confirmation of the booking, No1 Events Ltd agrees to use reasonable endeavours (such reasonable endeavours to be strictly subject to the organisers/promoters of events and/or other third parties making alternative packages available and further subjects to No1 Events Ltd right to change the price applicable) to provide a reasonable alternative package and the client agrees to accept such reasonable alternative package.
7.3 No1 Events Ltd have the right to change the price applicable to a booking (upwards or downwards) at any time prior to a booking being accepted.
8. Weather
Weather conditions may affect travel to and from the event and may cause a postponement or cancellation of the event. Such circumstances are beyond the control of No1 Events Ltd and accordingly no refund for unused services, or allowance for the loss or enjoyment caused by weather conditions will be made by No1 Events Ltd.
9. Transportation
No1 Events Ltd shall not be held responsible for damages, delays, cancellation or unavailability of public or private transportation caused by an act of God, by acts of war, riot, civil commotion, by an act of state, by strikes, fire, flood, restricted availability, or by the occurrence of any other event beyond the control of No1 Events Ltd.
10. Liability of No1 Events Ltd
10.1 The client hereby acknowledges that No1 Events Ltd acts as agent of the client in arranging the booking and that No1 Events Ltd will not be liable for any misrepresentations, negligence, contractual or tortuous loss of any kind whatsoever suffered by the client or any due to any act or omission by or on behalf of any third party.
10.2 In any event No1 Events Ltd shall not be liable for death or personal injury suffered by the client or it's guests arising out of the booking. This limitation of liability shall also extend to any loss or damage sustained by property or belongings of the client or any of the client's guests or for any further costs, demands or expenses incurred or suffered by the client arising out of the booking.
10.3 No1 Events Ltd will not be liable for any cancellation of or alteration to the booking or any loss or damage to the client arising out of circumstances beyond its control including but not limited to any act of god, natural disaster or act of terrorism.
11. Law and Construction
The contract of these terms and conditions shall be governed by English Law and No1 Events Ltd and the client hereby submits to the exclusive jurisdiction of the English Courts in all matters regarding the contracts and these Terms and Conditions.
Permitted Use
You agree that you are only authorised to visit, view and to retain a copy of pages of this Site for your own personal use, and that you shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than to review event and promotional information, for personal use, or to purchase tickets or merchandise for your personal use, unless otherwise specifically authorized by No1 Events Ltd to do so. You also agree not to deep-link to the site for any purpose, unless specifically authorised by No1 Events Ltd to do so. The content and software on this Site is the property of No1 Events Ltd and/or its suppliers and is protected by U.S. and international copyright laws. We post a legal notice and various credits on pages of the Site, which may not be removed. Please do not remove this notice or these credits, or any additional information contained along with the notices and credits.
Disclaimers
No1 Events Ltd does not promise that the Site will be error-free, uninterrupted, nor that it will provide specific results from use of the Site or any Content, search or link on it. The Site and its Content are delivered on an "as-is" and "as-available" basis. No1 Events Ltd cannot ensure that files you download from the Site will be free of viruses or contamination or destructive features. No1 Events Ltd disclaims all warranties, express or implied, including also any implied warranties of merchantability and fitness for a particular purpose. Violation of the Terms
You understand and agree that in No1 Events Ltd sole discretion, and without prior notice, No1 Events Ltd may terminate your access to the Site, cancel your ticket order or exercise any other remedy available and remove any unauthorized User Content, if No1 Events Ltd believes that the User Content you provided has violated or is inconsistent with these Terms of Use violated the rights of No1 Events Ltd, another User or the law. You agree that monetary damages may not provide a sufficient remedy to No1 Events Ltd for violations of these terms and conditions and you consent to injunctive or other equitable relief for such violations. No1 Events Ltd may release user information about you if required by law or subpoena, or if the information is necessary or appropriate to release to address an unlawful or harmful activity. No1 Events Ltd are not required to provide any refund to you if you are terminated as a User because you have violated these Terms of Use.
Limitation on Liability
Except in jurisdictions where such provisions are restricted, in no event will No1 Events Ltd be liable to you for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits, even if No1 Events Ltd has been advised of the possibility of such damages.
Disputes
This site is controlled and operated by No1 Events Ltd from its offices in the United Kingdom. If there is any dispute about or involving the Site, by using the Site, you agree that the dispute will be governed and construed by English law. In the event of a dispute arising out of or relating to these terms and conditions, or your use of or access to this site, litigation must be brought in court in London, England without regard to its conflict of law provisions.
Indemnity
You agree to indemnify and hold No1 Events Ltd, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Site, including also your use of the Site to provide a link to another site or to upload content or other information to the Site.
